Terms of Service

These Terms and Conditions ("Terms") govern your use of the VitalsTrack mobile application (the "App") and the website www.vitalstrack.com (the "Website"), as well as all related products, services, and features offered by VitalsTrack GmbH (hereinafter "VitalsTrack", "we", "us", or "our").

By accessing or using the App and/or the Website, you agree to these Terms and agree to be bound by them. If you do not agree to these Terms, you may not use the App or the Website.

1. General Provisions

1.1 Introduction and Definitions

These Terms apply to all offers, orders, and agreements relating to the products and/or services of VitalsTrack.

Definitions:

  • "Agreement": The agreement between you and VitalsTrack, which is governed by these Terms.
  • "App": The mobile application VitalsTrack, which allows users to capture and track blood pressure data by photographing the meter.
  • "Website": The website www.vitalstrack.com, which is used to promote the App and includes a blog section and community features.
  • "User" or "You": Any natural person who uses the App and/or the Website.
  • "Product": Refers to the App and its features.
  • "Services": The provision of the App and the Website, including all related features and content.
  • "User Content": Refers to all content uploaded, transmitted, or created by users on the Website or in the App, including (but not limited to) blood pressure data (photos and extracted readings) and comments in the blog section.

Important Notice: The VitalsTrack App is exclusively a data collection and tracking tool and NOT a medical device. It does NOT provide medical advice, diagnosis, or treatment. The App is not clinically validated as a medical device and does not replace the advice of a physician or qualified healthcare provider.

1.2 Offers and Agreement

By accessing, using, or purchasing VitalsTrack products and/or services, you agree to these Terms.

You confirm that you are a natural person who is at least 18 years old and does not intend to distribute, license, resell, or use the products or services for commercial purposes.

VitalsTrack reserves the right to refuse orders or access at its sole discretion, for example, in case of previous payment disputes, lack of availability, obvious errors in the fees, or suspicion of malicious behavior.

1.3 Prices and Payments

Unless otherwise stated, fees (if applicable) are displayed in your local currency and are valid only at the time of the offer. Fees include all costs associated with the offer and delivery, including taxes, duties, and insurance. Accepted payment methods are clearly listed on the Website or in the App.

The VitalsTrack App is currently offered for free. However, VitalsTrack reserves the right to introduce premium features or subscription models in the future, which may be subject to a fee.

1.4 Intellectual Property

All intellectual property rights, including copyrights, trademark rights, patents, and trade secrets, in relation to the App, the Website, the underlying software, the design, texts, photos, images, and other materials, are the exclusive property of VitalsTrack (or are managed with permission). You agree not to infringe these rights.

Handling of User Content:

  • Health Data (Photos and Extracted Readings): You grant VitalsTrack a non-exclusive, worldwide, royalty-free license to process, store, and display your uploaded blood pressure data (including the images from which data is extracted) solely for the purpose of providing the VitalsTrack service, improving App functionality, and for anonymized/aggregated research, statistical, and product development purposes.
  • Community Comments/Blog Posts: You retain ownership of your original comments and content that you post in the community areas of the Website. By posting, however, you grant VitalsTrack a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media, for purposes related to the operation, promotion, and improvement of the Website and its community features.

Note on Blog Content: The blog articles on the Website may contain information collected from external websites and converted into blog articles. VitalsTrack endeavors to ensure legal compliance (e.g., proper attribution, adherence to fair use principles, or obtaining necessary licenses) for all sourced content. However, you acknowledge that VitalsTrack assumes no responsibility for the original legality or copyright of the external sources from which the content originates.

1.5 Privacy

The collection, processing, and storage of personal data, including sensitive health data obtained from photo uploads, is detailed in the separate VitalsTrack Privacy Policy. We strongly encourage you to read this Privacy Policy for detailed information on data processing, security measures, and your rights.

1.6 Liability and Warranty

The VitalsTrack App and Website are for general informational and data collection purposes only and do NOT provide medical advice, diagnosis, or treatment. Use of the App and Website is at your own risk.

VitalsTrack is NOT a medical device and has not been clinically validated as such. We make no representations or warranties as to the accuracy or completeness of the information, particularly with respect to the accuracy of blood pressure readings extracted from photos you upload, as these depend on your external device and the quality of the photo.

VitalsTrack is not liable for indirect damages (e.g., consequential damages, lost profits, data corruption) to the extent permitted by law. VitalsTrack is also not liable for injuries resulting from misuse, failure to follow instructions (e.g., poor photo quality), or the use of data for medical decisions.

Should VitalsTrack be held liable, our liability is limited to the fees you paid for the products or services that caused the damages. If the App is free, liability is limited to a symbolic amount or zero, as permitted by law.

Nothing in these provisions excludes or limits liability for personal injury or death caused by gross negligence, willful misconduct, or product defects, to the extent required by law.
